Kidsout Terms of Use for Babysitter

1. Terms of Use This document (the “Agreement”) constitutes a legally binding agreement between you (the “User”) and Kidsout, and governs your use of the websites, mobile apps, and other products owned by Kidsout (hereinafter referred to as the "Kidsout Platform"). The terms "Kidsout," "we," "our," or "us" refer to the company specified in Appendix 1 with whom you enter into this Agreement.
Kidsout is an online platform that enables individuals (“Users”) to post, offer, search, and book childcare and child education services. Users who publish profiles and offer services are referred to as “Babysitters.” Users who search for and book services are referred to as “Clients.”
By accessing or using the Kidsout Platform, you acknowledge that you have read and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must cease using the Platform.
If you are representing a legal entity or using the Platform for commercial or client-facing purposes, a separate agreement must be signed. Please contact help@kidsout.app for access.
This Agreement constitutes a public offer. It is addressed to individuals over 18 years of age who wish to use the Platform for personal use as a babysitter.
This Agreement is publicly available at kidsout.app/licence. By registering (logging in) via social network or phone number either on the website or through the mobile app, the User accepts this offer in its entirety without changes. Registration does not require your social network password but requests permission to access public profile data.

2. Registration and Login 2.1. You may register on the Platform using your mobile phone number or a supported social network profile. Only one account is allowed per phone number. 2.2. Some features may be limited when registering via social network. To unlock all features, provide your phone number and email. 2.3. You warrant that you have the legal capacity to enter and fulfill this Agreement. 2.4. Login is available using your registered phone/email or linked social network. 2.5. You are responsible for the confidentiality of your login credentials. All activity under your account is considered yours. Notify Kidsout immediately if you suspect unauthorized access.

3. Babysitter Review Process 3.1. Before listing a Babysitter in the database, Kidsout reviews the data and documents submitted by the Babysitter. 3.2. Kidsout may deny inclusion in the Babysitter database if it determines the candidate does not meet Kidsout standards. 3.3. After a positive review, an interview may be conducted. Based on the interview, Kidsout may:
  • Approve listing in the Babysitter database.
  • Decline listing.
  • Recommend completing the Kidsout Babysitter School training. 3.4. Training is governed by a separate offer available for trainees. 3.5. Completion of training does not guarantee listing. The final decision is based on competencies, training performance, and a possible second interview. 3.6. Kidsout is not required to provide justification for declining a listing.
4. User Obligations Users agree to:
  • Provide accurate information during registration.
  • Not impersonate others or use unauthorized contact details.
  • Not share false or misleading information.
  • Submit supporting documents upon request (e.g., ID, work permits, education, background checks).
  • Keep contact and availability information up to date.
  • Communicate respectfully with Clients.
  • Maintain updated status and work schedule.
  • Follow Kidsout Interaction Rules.
  • Accept consequences for non-response (e.g., temporary account lock).
  • Not share Client photos, private data, or home environment online or with third parties.
  • Refrain from offensive language or defamatory reviews of Clients.
  • Maintain password confidentiality and be responsible for its misuse.
  • Handle disputes over content or image rights without involving Kidsout.
  • Not post illegal or harmful content.
  • Not interfere with Platform design or insert unauthorized code.
  • Use the Platform solely as permitted under this Agreement.
  • Contact Kidsout for support via email, in-app chat, or phone.
  • Delete their account at any time by emailing help@kidsout.app.
  • Not send automated queries without prior written consent.
5. Kidsout Responsibilities Kidsout will:
  • Provide registration and profile management tools.
  • Allow Babysitters to respond to job requests.
Kidsout is not an employer and has no legal or employment relationship with Users. All agreements between Babysitters and Clients are private.
Kidsout may:
  • Apply special terms to certain services.
  • Modify profiles without altering meaning.
  • Schedule maintenance (no more than once a month, 24 hours max).
  • Remove accounts or media at its discretion.
  • Suspend accounts for violating the Agreement.
  • Report unlawful activity to authorities.
  • Use public Babysitter profile content for marketing.
  • Make no guarantee that Babysitter profiles will be viewed by Clients.
6. Financial Terms Access to the Platform is free of charge for Babysitters.
7. Liability By using the Platform, the User agrees to the following:
  • Kidsout is an informational tool and does not offer professional advice.
  • We do not guarantee the Platform will be error-free, uninterrupted, or meet your expectations.
  • Kidsout is not responsible for the accuracy or completeness of Client or Babysitter profiles.
  • Users are responsible for their own accounts and any related activity.
  • Users are responsible for their content and the results of sharing it.
  • Kidsout does not control third-party links or external websites.
  • We strive to ensure data quality but disclaim liability for third-party inaccuracies.
  • Our review process and criteria for unreliable Babysitters are confidential.
  • Platform access may be disrupted due to technical maintenance or third-party providers.
  • We do not guarantee our systems are free of viruses or data loss.
  • Users shall indemnify Kidsout for any damages caused by their misuse, including legal claims.
  • Kidsout is not liable for any losses due to registration, use, or inability to use the Services.
8. Personal Data By registering, Users consent to the processing of their personal data, including cross-border transfers, and communications from Kidsout. Data may be used for compliance with laws and marketing purposes. Consent can be revoked by email to help@kidsout.app.
9. Intellectual Property All Platform content is protected intellectual property owned by Kidsout. Unauthorized use is prohibited. Users grant Kidsout a license to use their content for service promotion.
10. Use of Platform Materials Copying or use of Platform design, layout, or content is prohibited without permission. Online reposting must include a link to kidsout.app. Print materials must credit: “Kidsout Babysitting Service.”
11. Final Provisions
  • Nothing in this Agreement grants any license unless expressly stated.
  • This Agreement is governed by the laws of your jurisdiction.
  • We may update these Terms with notice posted online.
  • Continued use constitutes acceptance of updates.
  • Invalid provisions will be replaced with enforceable ones.
