Кidsout Terms of serviсe Agreement

This Agreement includes terms and definitions used throughout the document.
Definitions“Profile”
A form completed by a Babysitter during registration in the system. The Profile includes fields for entering the Babysitter’s first name, last name, date of birth, address, personal description, photograph, and other details provided voluntarily. The personal data specified in the Profile is visible only to Clients with whom the Babysitter has agreed to meet for the purpose of providing childcare services. The Profile must be filled out in accordance with the Profile Completion Guidelines.
“Database”
A collection of personal data about Babysitters obtained by the Operator, including information such as name, education, work experience, and other details from the Profile, processed and structured using electronic means so that Clients can search and access it via the Website and/or Mobile Application.
“Babysitter”
An individual aged 18 or older, acting as a temporary caregiver for children on an hourly basis, registered on the Website and/or Mobile Application under this Kidsout Terms of Service Agreement (available at https://eng.kidsout.app/licence_use) and who has created a Profile for the purpose of finding babysitting jobs via the platform.
“Access”
Limited functionality available to a User, excluding the ability to post job requests, contact Babysitters in the Database, or view their contact information. Full access requires a separate license agreement.
“Client”
An individual aged 18 or older who is seeking a Babysitter to provide childcare support, registered on the Website and/or Mobile Application in accordance with this Agreement (hereinafter referred to as “User”).
“Product Code”
Any components forming the foundation of the Website and/or Mobile Application, including but not limited to: source code, scripts, executable programs, software, and sets of instructions available through the platform.
“License Agreement”
An agreement between the User and the Operator that provides full access to the Services (“Paid Access”), available at https://eng.kidsout.app/licence_use.
“Mobile Application”
Software developed by the Operator for installation on mobile devices, allowing Users to create an account, post job requests, and access contact information of Babysitters from the Database for paid childcare services on a specific date and time.
“Operator”
The platform operator, which includes the company Kidsout LLC and/or its affiliated entities and advisors, authorized to process personal data provided by Users during registration.
“Password”
A confidential User-defined password used to access secure sections of the Website and/or Mobile Application.
“Paid Access”
A license-based subscription model that grants Users full use of the platform’s functionality, including access to the Babysitter Database and contact information, for a specified fee.
“Kidsout Platform”
A suite of websites, mobile apps, and other products owned and operated by Kidsout LLC.
“Website”
Software developed and maintained by the Operator and available online at kidsout.ru and eng.kidsout.app, including all related subdomains.
“Services”
The functionality available to the User through the Website and/or Mobile Application, including the ability to create a User Account, post babysitting jobs, and access Babysitter contact details to book childcare services.
“Platform Content”
All audio and/or visual elements of the Website and/or Mobile Application, whether created by the Operator or third parties, including but not limited to: the Database, text, graphics, photos, illustrations, animations, videos, audio and audiovisual content (such as promotional trailers or episode excerpts), interface design elements, logos, informational content, and other materials available on the platform.
“User Account”
A set of data stored by the Operator identifying the User and granting access to the Services. The Operator may request additional information or documents, such as a passport copy, for verification purposes.
